Man charged with drunk driving in a driveway

Illinois residents may have heard stories about people being charged with DUI or DWI when the vehicle was not even moving. Even if a vehicle does not move or only moves a few feet, a driver may face charges for drunk driving if he or she was behind the wheel at the time. Knowing this, it should not be too difficult to believe that a man was arrested on suspicion of driving under the influence in a driveway.

From what the reports indicate, a man was found lying underneath a truck in a driveway. Police were called to the scene where they did find a man with minor injuries. That man was taken to a local hospital for treatment.

As police inquired further, they alleged that a 26-year-old man was behind the wheel of the truck and struck the injured man. Supposedly, the driver was attempting to leave the home whose driveway the truck was in at around 12:30 a.m. Reports did not indicate what led police to believe that the Illinois man was impaired. These facts will become important as he defends against the charges.

The man accused of drunk driving retains the right to challenge his arrest. This often requires a thorough review of the circumstances to determine whether police officers made any mistakes or whether any of his rights were violated during the process.
